Terms of Use
These Terms of Use govern your use of the MindCareOS platform (the "Service"), operated by Rahul Dangi ("we", "us", "our"), trading as MindCareOS. By creating an account or using the Service you agree to be bound by these terms.
1. The Service
MindCareOS is a clinician-support software platform providing structured patient intake, screening questionnaire scoring, the MindSketch Visual Intake module, and editable AI-assisted report drafts. It is not a diagnostic device. A qualified clinician is responsible for every patient interaction, clinical decision, and final report.
2. Acceptance and authority
By continued use of the Service you accept these terms. If you use the Service on behalf of a clinic or organisation, you confirm that you have authority to bind that entity. Individual users must be of legal age in their jurisdiction.
3. Acceptable use
- You will use the Service only for lawful, professional clinical intake and screening purposes.
- You will obtain valid patient consent — and guardian consent for minors — before collecting data.
- You will not misuse the Service, including via fraud, spam, IP infringement, malware, scraping, probing, or other security interference.
- You will not rely on AI-generated drafts without clinician review and sign-off.
- You will keep your account credentials confidential and are responsible for activity under your account.
4. Intellectual property
The Service, including all software, documentation, design, branding, and the MindSketch and MindCareOS marks, is owned by Rahul Dangi and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service within the plan you have subscribed to. You may not reverse engineer, resell, redistribute, or circumvent technical limits of the Service. You retain ownership of patient and clinical content you upload; you grant us a limited licence to host and process that content solely to provide the Service.
5. Payments, subscriptions and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, applicable taxes, cancellation and refund mechanics are governed by Paddle's Buyer Terms in addition to these Terms. Trial accounts include a 30-day free period; paid subscriptions renew automatically at the cadence and price shown at checkout until cancelled. See our Refund Policy for refund details.
6. Service levels and warranty disclaimer
The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, secure against every threat, or fit for any particular clinical purpose. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, goodwill, or clinical outcomes. Nothing in these terms excludes liability where it cannot lawfully be excluded.
8. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, regulatory requirement, or repeated or serious policy violations. On termination, your right to use the Service ends; you may request export or deletion of your clinical records subject to record-keeping obligations.
9. AI-assisted features
- AI-generated text is a draft only and may be inaccurate; the clinician must verify and edit before clinical use.
- You are responsible for the inputs you provide and for ensuring you have rights to that content.
- The Service must not be used to produce illegal content, deepfakes, hate speech, malware, or to jailbreak the model.
- We may filter, refuse, or remove outputs and may suspend accounts for repeated misuse.
- Outputs are not a substitute for regulated professional advice and must always be reviewed by a qualified clinician.
10. Governing law
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the competent courts in India, without prejudice to any mandatory consumer rights in your country of residence.
11. Changes
These terms may be updated from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
